By accessing or using myTCRPlus services, websites, or compliance microsites, you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, do not use our services.

2. DESCRIPTION OF SERVICES

myTCRPlus provides compliance microsite development, hosting, and maintenance services for business SMS/MMS messaging programs. Our services include:

  • Compliance microsite creation with required regulatory disclosures
  • Privacy policies, terms of service, and consent language development
  • Sample message templates and opt-in/opt-out mechanisms
  • SSL hosting, security updates, and technical maintenance
  • Regulatory monitoring and content updates
  • Customer support and consultation services

3. SERVICE PLANS AND BILLING

Service Tiers:

  • Basic Plan: $29.99/month + $299.00 setup fee
  • Standard Plan: $39.99/month + $399.00 setup fee
  • Plus Plan: $49.99/month + $499.00 setup fee

Billing Terms:

  • Setup fees are due upon service activation
  • Monthly fees are billed in advance on your subscription date
  • All fees are non-refundable except as required by law
  • Price changes require 30 days advance notice
  • Failed payments may result in service suspension after 7 days

4. CLIENT RESPONSIBILITIES

You agree to:

  • Provide accurate business information and branding materials
  • Ensure all content provided complies with applicable laws
  • Maintain current contact information and billing details
  • Use services only for legitimate business messaging purposes
  • Comply with TCR, TCPA, CTIA, and all applicable regulations
  • Not use services for illegal, harmful, or prohibited content

5. PROHIBITED CONTENT AND USES

You may not use our services for:

  • Gambling, illegal substances, or explicit sexual content
  • High-risk financial services (cryptocurrency, NFTs, hedge funds)
  • Lead generation, affiliate marketing, or third-party job boards
  • Hate speech, harassment, or discriminatory content
  • Spam, unsolicited marketing, or consent violations
  • Any content that violates TCPA, CTIA, or carrier policies

6. INTELLECTUAL PROPERTY

  • You retain ownership of your trademarks, logos, and business content
  • myTCRPlus retains ownership of our proprietary templates, software, and methodologies
  • You grant us license to use your content solely to provide contracted services
  • We may use anonymized case studies and compliance examples for marketing

7. SERVICE LEVEL COMMITMENTS

Uptime: We target 99.9% uptime with 24/7 monitoring and automatic failover systems.

Support Response Times:

  • Basic Plan: Within 24 hours during business days
  • Standard Plan: Within 12 hours during business days
  • Plus Plan: Within 4 hours including weekends

Setup Timelines:

  • Basic Plan: 5 business days
  • Standard Plan: 2-3 business days
  • Plus Plan: 2-3 business days with dedicated management

8. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR SERVICES IN THE 12 MONTHS PRECEDING THE CLAIM
  • WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • WE DO NOT GUARANTEE CARRIER APPROVAL OR REGULATORY COMPLIANCE OUTCOMES
  • YOU ASSUME RESPONSIBILITY FOR YOUR MESSAGING PROGRAM’S LEGAL COMPLIANCE

9. COMPLIANCE DISCLAIMER

IMPORTANT: myTCRPlus provides tools and templates to support compliance efforts, but we do not provide legal advice. Compliance requirements vary by industry, jurisdiction, and use case. You are responsible for:

  • Ensuring your messaging program complies with all applicable laws
  • Obtaining proper legal counsel for your specific situation
  • Maintaining current knowledge of regulatory requirements
  • Implementing appropriate consent and opt-out mechanisms

Messaging programs must comply with TCPA, CTIA guidelines, and carrier policies. Regulatory outcomes may vary based on program specifics.

10. MODIFICATIONS AND UPDATES

We reserve the right to:

  • Modify these Terms with 30 days notice for material changes
  • Update service features and capabilities without notice
  • Adjust pricing with 30 days advance notice
  • Discontinue services with 60 days notice and pro-rated refunds

11. TERMINATION

By You: Cancel anytime with 30 days notice. No refunds for prepaid fees or setup costs.

By Us: We may terminate for breach of Terms, non-payment, or prohibited use with 7 days notice.

Effect of Termination:

  • Service access ends immediately upon termination
  • You receive export of your content within 30 days
  • All payment obligations remain due
  • Survival of confidentiality, liability, and dispute resolution terms

12. DATA PROTECTION AND PRIVACY

Your use of our services is governed by our Privacy Policy, incorporated by reference. We implement reasonable security measures but cannot guarantee absolute security of transmitted data.

13. FORCE MAJEURE

We are not liable for delays or failures due to circumstances beyond our reasonable control, including natural disasters, government actions, internet outages, or third-party service disruptions.

14. DISPUTE RESOLUTION

Governing Law: These Terms are governed by Nevada state law.

Dispute Process:

  1. Informal resolution through direct communication (30 days)
  2. Binding arbitration under American Arbitration Association rules
  3. Arbitration location: Las Vegas, Nevada
  4. No class action lawsuits permitted

15. GENERAL PROVISIONS

  • Entire Agreement: These Terms constitute the complete agreement between parties
  • Severability: Invalid provisions do not affect remaining Terms
  • Waiver: Failure to enforce provisions does not constitute waiver
  • Assignment: We may assign these Terms; you may not without consent
  • Notices: Legal notices sent to your registered email address

If you consent to receive text messages from myTCRPlus:

Opt-Out: Reply STOP to any message to unsubscribe. You will receive confirmation of opt-out.
