Who this course is for
- Brokers and team leads overseeing agent texting
- Real estate agents prospecting and nurturing leads
- Transaction coordinators and office staff
- CRM administrators for brokerages
Why texting compliance is different for brokerages and real estate teams
Real estate agents text constantly, often from personal phones and CRMs the brokerage does not control. Prospecting is the main risk: texting expired listings, FSBO owners or numbers pulled from public records and skip-tracing tools without consent, many of which are on the Do Not Call Registry. Portal leads from listing sites come with consent that may name the portal rather than the agent, and team structures blur who is responsible for each conversation.
What each module covers
- TCPA Foundations for Real Estate. The TCPA as it applies to brokerages and real estate teams: consent tiers, autodialer rules after Facebook v. Duguid, Do Not Call obligations, statutory damages and recent case law.
- TCR Registration. 10DLC registration for brokerages and real estate teams: brand and campaign structure, use case selection, vetting, and keeping registrations accurate as the business changes.
- Agent Consent Management. How to capture, scope and document consent for brokerages and real estate teams: express versus express written consent, disclosure language, recordkeeping and consent that survives a challenge.
- Message Classification. For brokerages and real estate teams: classifying messages as informational, transactional, conversational or marketing, and why the classification decides which consent and which campaign apply.
- Contamination Prevention. For brokerages and real estate teams: preventing contamination: keeping marketing content out of informational and transactional messages so consent and registrations stay valid.
- Opt-Out Management. For brokerages and real estate teams: processing STOP and other opt-outs across every system, honoring revocation by any reasonable means, and keeping internal and national DNC lists synchronized.
- Portal Compliance. For brokerages and real estate teams: managing vendors and platforms that send or store data on your behalf: due diligence, contracts, audit rights, suppression syncing and liability allocation.
- CRM Risk Management. Applied guidance on cRM Risk Management for brokerages and real estate teams, with templates, checklists and case studies drawn from real programs.
- Public Data Consent Requirements. For brokerages and real estate teams: assessing purchased, rented and sourced data: why lead-generation consent often fails, vendor diligence, list hygiene and the Reassigned Numbers Database.
- Team & Brokerage Compliance. For brokerages and real estate teams: running compliance across multiple locations, brands or teams: centralized controls, shared suppression, registration structures and local accountability.
- Transaction Documentation. For brokerages and real estate teams: building the evidence trail: consent logs, message archives, monitoring dashboards and the records regulators, carriers and plaintiffs request.
- Litigation Defense Strategies. For brokerages and real estate teams: responding to complaints, demand letters, class actions and regulator inquiries: preserving evidence, common defenses and settlement considerations.
- Final Certification Exam. A proctored final assessment covering every module, with scenario questions drawn from real brokerages and real estate teams situations. Passing earns the course certificate.
The problem this course prevents
A team uses a skip-tracing tool to text owners of expired listings about relisting. Dozens of numbers are on the DNC Registry and none consented. The course covers public data consent requirements, portal lead consent and brokerage-level controls over agent CRMs.
Course FAQ
Can agents text expired listing or FSBO owners?
Not with marketing messages unless the owner has consented. Public availability of the number does not create consent. The public data module covers the rules.
Are agents or brokerages liable for agent texts?
Both can be. The team and brokerage compliance module covers supervision, CRM controls and policies.
Is the course self-paced?
Yes. Real Estate Messaging Compliance runs about 20 hours across 13 modules, including the final exam, and you can work through it at your own pace with lifetime access to updates.
Is this course legal advice?
No. It teaches the rules, carrier requirements and operational controls that apply to brokerages and real estate teams, but it is not a substitute for advice from qualified counsel on your specific program.
